CourtFormer managers of Rodange grocers in court for fraudulent bankruptcy

The couple that used to be the managers of a Rodange greengrocers were in court on Monday due to their declaration of bankruptcy in 2016.

The two former managers stand accused of misuse of company assets. The prosecutor cited fraudulent bankruptcy as one of the charges amongst another.

The prosecutor called for both defendants to be sentenced to suspended sentences of six months and to pay back the money claimed from their actions, which lies at €68,000. Each defendant stands accused of having embezzled €34,000.

The trial also concerned the fact that the business capital was sold for around €127,500. Crucially, the lawyer in charge of the bankruptcy had no idea of the sale. Around €10,500 had already been misappropriated three months prior to the declaration of bankruptcy. According to the defendants, they used this money to pay bills.

The lawyer had also not received any information about the technical installations worth €23,500 that occurred at the time of bankruptcy.

The first accountant present at the trial on Monday claimed to have stopped looking after the grocers' accounts as he had not been paid. The second accountant presented proof of the business capital sale, something nobody had been aware of.

One of the defendants attempted to lay the blame on the first accountant. The defendants' lawyer echoed this justification, claiming that his clients were incapable of differentiating between their own money and that of the business.

The verdict will take place on 24 January.
