
Following the incident, which occurred at a Hesperange primary school on 27 October 2021, the prosecution recommended an eight-year prison sentence. The accused’s defence said punishment was necessary, but requested a combination of therapy and punishment outside of a fixed sentence.
The accused, aged 29 at the time, took his niece to school on the day of the incident, using it as an opportunity to gain access to the premises. He then attacked the six-year-old victim in the girls’ toilets within the school and filmed the assault.
The court heard that the accused was a voyeur and an exhibitionist, who possessed indecent images of children on his mobile phone and had also been found filming under women’s skirts (known as upskirting).
The man apologised to the court in tears, saying he was ashamed and claiming he was sick.
