
The Administrative Court thus annulled the 2017 decisions by the capital's municipality, as well as then-minister Dan Kersch, which granted and officially certified a new PAG statute. The regulation classified parcels in Eich as a "sector protected by municipal interest".
In the first case, costs have to be split 40/60 between the company and the municipality and the state. In the other case, city and state have to cover all costs.
The Luxembourg City municipality gave its blessing for the new PAG regulation in 2016. Two companies, which own six parcels in the area, initially complained about the regulation. A lengthy process, which involved contacting Dan Kersch, who was the Minister of the Interior at the time. The latter granted the regulations without considering the concerns of the two companies in question. They subsequently brought their case to the Administrative Court in January 2018.
The dispute surrounded a questionable ruling, through which a number of buildings in Eich were considered to be historically protected, while others without any visual difference were left out. The court ruled that there was in fact insufficient justification for the decision, which is why it was annulled.
