The public prosecutor has demanded twelve- and six-month suspended prison sentences, as well as financial penalties, for two of the three sculptors involved in the fatal incident. A suspended sentence and a fine have also been requested for a staff member of the Luxembourg City Tourist Office (LCTO) who ordered and negotiated the installation on behalf of the office.
As he acted in the name of the LCTO, the prosecutor's office also recommended the tourist office be convicted and fined in the matter. All other defendants should be acquitted, the prosecution concluded. This was primarily due to the fact that the LCTO employee who had ordered the sculpture from the artist had not informed anyone that it was intended to be a backdrop of 2.5 metres high. As a result, no one at the LCTO or at the municipal council could plan appropriate safety measures for the sculpture.
Thursday was the first day of the trial in which Emran, the 2-year-old victim, was directly referred to in court. The toddler's parents shared their account of the accident with great dignity, and described how their lives have been since the loss of their son.
